iMax IPTV respects intellectual property rights and complies with the Digital Millennium Copyright Act, 17 U.S.C. section 512. This page explains how to notify us of a claimed infringement and what happens after you do.

We do not host channel feeds, film files or series files on our own servers. Where a notice identifies material reachable through our service, we review it, escalate it to the upstream supplier concerned and, where the notice is valid, withdraw access from our side.

Filing a notice of claimed infringement

If you own a copyright, or are authorised to act for the owner, send a written notice to our designated agent containing all of the following:

Your full legal
Your email
Your telephone
Your physical mailing
Identification of the copyrighted work claimed to have been infringed. Where multiple works are covered by one notice, provide a representative list or an attached schedule.
Identification of the material claimed to be infringing, described with enough particularity for us to locate it. Include channel names, package names, event titles, content titles and any relevant URLs.
A statement that you have a good faith belief that the use complained of is not authorised by the copyright owner, its agent or the law.
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner’s behalf.

Notices missing the good faith statement, the accuracy statement or a signature do not meet the statutory requirements and will be returned for completion.

Our process

Receipt of every notice is acknowledged. We then verify that the notice is complete and that the material described is in fact reachable through our service. Valid complaints are investigated and acted upon within 24 hours of the notice being confirmed complete.

Depending on the subject of the notice, action may consist of removing a channel or title from our lineup, escalating the notice to the supplier that provides the feed, or disabling a subscriber account.

We maintain a log of notices received and the action taken in response to each.

Repeat infringers

Accounts belonging to subscribers who repeatedly infringe copyright are terminated. Where a subscriber is the subject of multiple valid notices, access is withdrawn and the balance of the subscription term is forfeited.

Counter notification

If your material or account was removed or disabled and you believe this resulted from a mistake or a misidentification, you may submit a counter notification containing:

Identification of the material removed or disabled and the location at which it appeared before
A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
A statement consenting to the jurisdiction of the United States District Court for the Eastern District of Pennsylvania, or, if your address is outside the United States, to the jurisdiction of any judicial district in which iMax IPTV may be found, together with your agreement to accept service of process from the complainant or the complainant’s agent.

Counter notifications go to the same address as takedown notices.

Valid counter notifications are forwarded to the original complainant. If the complainant does not notify us within 10 to 14 business days that a court action has been filed, we may restore the material or the account.

Misrepresentation

Section 512(f) of the DMCA creates liability for anyone who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake. This includes asserting ownership of a work you do not own and using the notice process against a competitor. Damages, costs and attorneys’ fees may be awarded. Verify your claim before submitting it.
